General Terms and Conditions for Subscription Services:
Scope of Services: The services provided under the subscription will be as described in the subscription plan selected by the client at the time of sign-up.
Client Responsibilities: The client shall provide all necessary information and cooperation to facilitate the provision of services.
Payment Terms: Subscription service fees are due per the selected plan's schedule. Late payments may result in a temporary suspension or cancellation of services.
Intellectual Property: All designs and documents produced by the service provider during the subscription period remain the intellectual property of the service provider until all outstanding fees are paid including current cycle.
Confidentiality: Both parties agree to maintain the confidentiality of any proprietary information exchanged during the subscription period and for a period of 12 months post the subscription ending date.
Dispute Resolution: Any disputes arising from the subscription services will be resolved through mediation, followed by arbitration if necessary, in accordance with the NZIA Guidelines.
Termination: The client may terminate the subscription with written notice within 10 working days of next billing cycle. The service provider may also terminate the subscription for breach of terms after providing appropriate notice.
Liability: The service provider's liability for any claims related to the subscription services shall be limited to the total fees paid by the client during the subscription period.
Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand.
Amendments: These terms and conditions may be amended occasionally, becoming effective upon notification to the client.
Standard Contract Forms: Prior to commencing any project work, the client agrees to engage under the standard contract forms provided by Te Kāhui Whaihanga New Zealand Institute of Architects (NZIA).
Architectural Design and Services Packages: Architectural design and service packages are not included in the subscription fee and can be purchased separately.
General Terms and Conditions for Design Packages:
Scope of Services: The services provided with this Design Package will be agreed between the architect and the client within three business days of purchase.
Client Responsibilities: The client shall provide all necessary information and cooperation to facilitate the provision of services, including a detailed brief of the project scope, budget and estimated timelines.
Payment Terms: Design Package costs are paid in advance unless otherwise agreed with the client. Late payments may result in a temporary suspension or cancellation of services.
Intellectual Property: All designs and documents produced by the service provider during the service period remain the intellectual property of the service provider until all outstanding fees are paid in full.
Confidentiality: Both parties agree to maintain the confidentiality of any proprietary information exchanged during the subscription period and for a period of 12 months post the subscription ending date.
